{"id":1479,"date":"2026-01-12T20:48:14","date_gmt":"2026-01-12T15:48:14","guid":{"rendered":"https:\/\/custombulletin.com\/english\/?p=1479"},"modified":"2026-01-12T20:48:14","modified_gmt":"2026-01-12T15:48:14","slug":"fto-terms-unlawful-bank-attachment-and-six-year-delay-as-maladministration-issues-strong-directions-against-fbr-officials","status":"publish","type":"post","link":"https:\/\/custombulletin.com\/english\/2026\/01\/12\/fto-terms-unlawful-bank-attachment-and-six-year-delay-as-maladministration-issues-strong-directions-against-fbr-officials\/","title":{"rendered":"FTO Terms Unlawful Bank Attachment and Six-Year Delay as Maladministration, Issues Strong Directions Against FBR Officials"},"content":{"rendered":"<p data-start=\"3067\" data-end=\"3422\"><strong data-start=\"3067\" data-end=\"3079\">Karachi:<\/strong> In a significant ruling, the <strong data-start=\"3111\" data-end=\"3142\">Federal Tax Ombudsman (FTO)<\/strong> has held the <strong data-start=\"3156\" data-end=\"3190\">Federal Board of Revenue (FBR)<\/strong>, particularly the <strong data-start=\"3209\" data-end=\"3270\">Commissioner Inland Revenue, Refund Zone, RTO-II, Karachi<\/strong>, guilty of <strong data-start=\"3282\" data-end=\"3303\">maladministration<\/strong> for unlawful recovery through bank attachment and an inordinate delay of more than six years in issuing appeal effect.<\/p>\n<p data-start=\"3424\" data-end=\"3558\">The decision was passed on a complaint filed by <strong data-start=\"3472\" data-end=\"3479\">AQP<\/strong>, a services provider and registered taxpayer, pertaining to <strong data-start=\"3540\" data-end=\"3557\">Tax Year 2014<\/strong>.<\/p>\n<p data-start=\"3560\" data-end=\"3834\">The FTO noted that an assessment order under <strong data-start=\"3605\" data-end=\"3654\">Section 122 of the Income Tax Ordinance, 2001<\/strong>, dated <strong data-start=\"3662\" data-end=\"3680\">27 August 2018<\/strong>, created a tax demand of <strong data-start=\"3706\" data-end=\"3727\">Rs. 19.19 million<\/strong>, out of which <strong data-start=\"3742\" data-end=\"3766\">over Rs. 5.2 million<\/strong> was forcibly recovered by attaching the complainant\u2019s bank account.<\/p>\n<p data-start=\"3836\" data-end=\"4068\">Subsequently, the <strong data-start=\"3854\" data-end=\"3906\">Commissioner Inland Revenue (Appeals-V), Karachi<\/strong>, vide <strong data-start=\"3913\" data-end=\"3962\">Order-in-Appeal No. 22 dated 12 February 2019<\/strong>, annulled the assessment order and directed the department to re-examine the case in accordance with law.<\/p>\n<p data-start=\"4070\" data-end=\"4323\">Despite clear appellate directions, the department failed to issue the appeal effect for more than six years. When the appeal effect was finally issued on <strong data-start=\"4225\" data-end=\"4245\">24 November 2025<\/strong>, the recovered amount was not credited, resulting in denial of lawful refund.<\/p>\n<p data-start=\"4325\" data-end=\"4553\">The FTO also expressed serious concern over repeated non-appearance of departmental representatives during hearings held on <strong data-start=\"4449\" data-end=\"4498\">28 November, 5 December, and 12 December 2025<\/strong>, which further demonstrated administrative negligence.<\/p>\n<p data-start=\"4555\" data-end=\"4769\">Terming the conduct as blatant maladministration, the FTO observed that such prolonged inaction caused severe financial loss and mental distress to the taxpayer and undermined the credibility of tax administration.<\/p>\n<h3 data-start=\"4771\" data-end=\"4807\"><strong data-start=\"4775\" data-end=\"4807\">Key Directions Issued by FTO<\/strong><\/h3>\n<p data-start=\"4808\" data-end=\"4849\">The FTO has recommended that the <strong data-start=\"4841\" data-end=\"4848\">FBR<\/strong>:<\/p>\n<ul>\n<li data-start=\"4853\" data-end=\"4942\">Fix responsibility for the unjustified six-year delay in implementing appellate orders;<\/li>\n<li data-start=\"4945\" data-end=\"5007\">Initiate action for non-compliance with FTO hearing notices;<\/li>\n<li data-start=\"5010\" data-end=\"5094\">Rectify the appeal effect by allowing credit of the forcibly recovered tax amount;<\/li>\n<li data-start=\"5097\" data-end=\"5157\">Ensure immediate disposal of refund for Tax Year 2014; and<\/li>\n<li data-start=\"5160\" data-end=\"5206\">Submit a compliance report within <strong data-start=\"5194\" data-end=\"5205\">45 days<\/strong><\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>Karachi: In a significant ruling, the Federal Tax Ombudsman (FTO) has held the Federal Board of Revenue (FBR), particularly the Commissioner Inland Revenue, Refund Zone, RTO-II, Karachi, guilty of maladministration for unlawful recovery through bank attachment and an inordinate delay of more than six years in issuing appeal effect.
